The article focuses on the legal meaning of the expression civil society. It was not my purpose to make the story of the different meanings that the expression has had in the constitutional tradition of the continental Europe, since the Enlightenment until today; nor to search for a common meaning that the expression may have in the every day language used now by lawyers. I simply wanted work on the base of the following hypothesis: (i) periods of constitutional transitions are also periods of renewal of language; (ii) by renewal of language we can mean either the appearance of new words or expressions, either the re-utilization of older expressions with renewed meanings; (iii) the expression civil society is an old expression that is now re-used by constitutional lawyers in continental Europe, (iv) that correponds to a specfic need felt by constitutional tradition of the continental Europe, in its present period of constitutional transition.
