This paper is a critique to the governmental proposal to amend the law on State Liability. The critique concerns solely article 15 of the proposal, which deals with liability for legislative acts. The main argument is that, on this point, the proposal breaches the Constitution, because it implies structural changes on the constitutional system of judicial review of laws.
