For more than one hundred years the civil proceedings in Portugal has been rigid. The Decree-Law n.º 108/2006 of June, approving the experimental procedural regime (Regime Processual Experimental - RPE), introduced in our legal system a type of proceedings which is completely different from the previous one. The Portuguese lawmaker took with this Act the biggest step so far towards procedural flexibility. This article analyzes the new type of proceedings, describes the path pursued towards this type as well as the historical antecedents explaining it. It stresses the increase of the judge's powers within the scope of the procedural forms and the consequences of this reinforcement for the diminution of guarantees. Finally, it provides an answer to the consistent whether a flexible proceedings is enshrined in the experimental procedural regime, as announced, or whether we are dealing with a different paradigm, which it would be better to refer to as liquid proceedings.
