This article considers the liability of the police for negligent investigation. It argues that police's traditional immunity from negligence has been eroded following recent decisions by the European Court of Human Rights in Strasbourg.Two decisions, “Osman vs UK” and “Menson vs UK” have had a significant impact upon the liability of the police service with regard to their duties to safeguard life and conduct an efficient investigation. This article focuses on these two important cases and the impact they have had on the developing the law of police liability for negligent investigation.
