Recent developments of Tartu Vangla and Komisia CJEU decisions (2021) are scrutinised in relation to the direct discrimination test, occupational requirement justification and related limitations on automatic employment bars. Incapability to fulfil the original position is debated in the light of the reasonable accommodation duty. As a contrast, in the latest HR Rail judgment (2022) the existence of incapability is not disputed, but the first independent CJEU test on denial of reasonable accommodation led to a cautious paradigm shift. In addition, the compulsory reassignment of incapable workers with a disability poses a challenge for national labour laws and reasonable accommodation regulations.
