The essay focuses on the difficult application in Italy of the provisions of Article 9(1) of Directive 2014/104/EU, on the subject of breach of competition law. The main issue concerns the powers of the administrative judge on the technical assessments made by the Antitrust Authority, in particular when they concern technical profiles, which have an objective margin of opinability. The proposed solution differs from those suggested by the doctrine and applied by the jurisprudence.
