The article discusses the opinion of AG Bot in the first preliminary ruling concerning the regulation on succession, Kubicka. It points out why the wording of the regulation permits a solution that forces land register systems like the German one to accept foreign legata per vindicationem even if that kind of legacy is not possible under domestic law On the other hand, at least some practical concerns about legal certainty should be kept in mind. The whole case shows the systemic consequences of the regulation.
