Following the recent legislative measures enacted in Italy with regard to same-sex unions, some specific provisions were introduced in law No. 218/1995 on private international law in order to regulate civil partnerships and de facto cohabitations. The new provisions concerning civil partnerships are modelled on the existing conflict rules on marriage. However, some new solutions have been envisaged in order to facilitate same-sex couples, in compliance with Article 2 of the Italian Constitution and Article 8 of the European Convention on Human Rights. On the other hand, some provisions tend to prevent a fraude à la loi by Italian nationals who may be tempted to take advantage of more favourable regimes that are applicable under a foreign law. There are also several references to the regulations adopted by the European Union under Article 81 TFEU, especially with regard to the law applicable to legal separation, divorce and maintenance, as a result, Italian courts will have to apply similar rules to those applicable to marriage.
