La legge n. 106/2016 ha autorizzato il governo a emanare una nuova normativa del settore non profit e a riformare le norme del codice civile relative alle associazioni e alle fondazioni. Nel 2017 sono state approvate due leggi, una sull’impresa sociale (112/2017) ed una sulle organizzazioni senza scopo di lucro (117/2017), ma non vi è stato alcun intervento sul codice civile. Le nuove leggi non coincidono sempre con le vecchie regole del codice civile e l'interprete deve cercare di farle combaciare, in attesa di una nuova riforma legislativa. Italian law 106/2016 authorized the Government to enact a new legislation in the non profit sector and to reform the rules of the civil code relating associations and foundations. In 2017 two laws were approved, on social enterprises (112/2017) and on non profit organizations (117/2017), but none regarding the civil code. The new laws don’t always overlap with the old rules of the civil code and the interpreter must try to make them match, waiting a new legislative reform.
