The present article deals with the theme of justice, at the same time following and distancing itself from the leading lines of research in the field of law and literature. Following them when treating justice «within literature» and «as literature». Moving away from them when dealing with justice as an allembracing literary system, considered by the political and legal rhetoric as the ultimate aim of the law, even if not cogent and lacking historical authenticity. Judicial organization, almost synonymous with justice, is not touched upon in this article; the topic under discussion, another element of «literary justice», rather steering the reader’s attention towards the linguistic-descriptive / linguistic-narrative element of law. In other words, it is through the door of justice that we leave the world of law and enter that of literature. During this journey the time of globalization wanes in the judicial discourse, and is replaced by a tighter time, linked to concrete situations. It is within this sphere that the «reality of anguish» of the human condition (it will suffice to mention prisons) – sometimes caused by the same agents of the above-mentioned political and legal rhetoric on the subject of justice – is consumed. It is thus that a conflict between law and literature takes place, a conflict that ought to be prefigured and tried out dialectically, aiming at formative and ethically oriented results.
