This article aims at assessing whether, and to what extent, State measures financing health care services provided by private and public hospitals fall under the scope of State aid rules. This raises, in turn, another question: how State aid rules may influence the functioning of National Health Care Systems? Both are delicate and problematic issues that have been highly debated over recent years. In order to deal with such issues, I will examine the concept of undertaking and the application of the provisions for Services of General Economic Interest in the healthcare sector, by taking into consideration the case-law and decision practice of the EU Court of justice and Commission. I will argue that the wider the enforcement of State aid rules in the healthcare sector, the higher are the benefits in terms of efficiency, cost-saving and Essential Level of Cares.
