Civil law protects the unborn and recognises his or her own personality rights. This protection is absolutely necessary, as the axiological foundation of the law and the idea that the unborn is a person are taken into consideration. In this paper, we try to underline that, even in certain cases where abortion is not punishable under the criminal la~ the father who opposes the death of the unborn can demand a claim on damages on the child’s behalf. Thus, we have to face the rule of the beginning of legal personhood, in order to harmonise that rule with the solutions in the legal system as a whole.
