The present article intends to analyze the compliance of the regime set forth in article 225 of the Portuguese Criminal Procedure Code which foresees the extra-contractual liability of the State for damages resulting from the criminal judicial power, related to the undue deprivation of liberty, with the Portuguese Constitution and the judicial precedents of the European Court of Human Rights. We consider that the created regime proves to be insufficient to respond to all situations that may result from a judicial absolution based on the principle in dubio pro reo. To that extent, we will focus on the system of compensation for unlawful or unjustified deprivation of liberty, and conclude with that analysis of paragraph c) of number 1 of article 225 of the Portuguese Criminal Procedure Code and the possible violation of constitutional principles such as presumption of innocence, equality and proportionality.
