In Lounani the Court of Justice of the European Union found that acts constituting participation in the activities of a terrorist group may justify the exclusion of refugee status, even when it is not established that the person concerned committed a terrorist act, or attempted or threatened to commit it. The Court’s reasoning is not entirely consistent with the applicable rules of the EU law and of international law. Not every “terrorist” act should lead to the exclusion of refugee status: it depends on its gravity, international impact, and implications for international peace and security. Moreover, the fact of being a member of a “terrorist” organization should not be sufficient, in the absence of the commission of terrorist acts or other form of participation in those acts. The position taken by the Grand Chamber in Lounani is also inconsistent with the previous jurisprudence of the Court.
