The article reflects on the independence of the Judiciary in the globalization age, focusing on the position of common judges. Both the processes of constitutional transition and the increase of international human rights chartersurge the definition of common standards to guarantee the independence of the Judiciary, at regional and universal level. After the analysis of the Basic Principles on the Independence of the Judiciary, endorsed by the General Assembly of the United Nation in 1985, the article focuses on the European experience, taking into consideration the documents adopted by the Council of Europe and the case-law of the Strasbourg Court. In this way, it highlights a common framework of guarantees to assure judges’ independence, pointing out the difficulties of its implementation at the same time.
