The analysis and comparison of two of the most important decisions of the US Supreme Court in recent years offer an opportunity for a broader reflection on the legal — and moral — legacy of Obama Administration and on some thorny issues of the contemporary constitutionalism. An opportunity to consider the complicated relationship between judges and legislators in protecting the fundamental freedoms, especially in light of the crisis of the welfare state and the «cost» of right’s’ argument. On the one hand Obergefell v. Hodges, in which the Court has recognized same-sex marriage across the country, welcoming the President’s invitation to extend civil rights to gay couples, and on the other side, King v. Burzvell, in which the nine Justices have established the constitutionality of the subsidies provided on the federal health insurance exchange, thereby definitely legitimizing the Obama health care reform. Both decisions were taken by a sharply divided Supreme Court, whose judges in the various dissenting opinions did not spare any harsh criticism of the role of the Court within the democratic system.
