The article revisits Art. 290 of the Portuguese Civil Code, whereby the legislature — despite asserting in Art. 289 the retroactive effectiveness of nullity and avoid ability — protects good faith of third parties, purchasers of interests at consideration, by preventing the jeopardizing of the respective “acquisitive fact” by the declaration of nullity or the annulment of a prior act, encompassing an exception to the nemo plus iuris principle.
