A new way of doing business is leading the way nowadays; it is called collaborative economy and gives opportunity to everyone to share their own goods, skills, assets and time in order to make profits. It founds its roots in the development of internet and mobile technology. The European Commission and the national Parliaments are struggling to propose a new regulatory approach to some problematic issues raised by the collaborative economy. The present article, inspired by the recent ECJ judgment on the case Uber Spain, aims at analyzing development of collaborative economy, underlining how European and Italian law may apply to this new industrial phenomenon.
