By examining the genesis of the divisio between “rights” and “principles” enshrined in the Charter of fundamental rights of the European Union, this essay focuses on the process of emancipation of (some) social rights from “principles” to “fundamental rights” in themselves. It especially assesses the consequences of such quality in terms of possibility of relying directly on the provisions of the Charter in disputes between individuals (direct horizontal effect), taking into consideration the most recent case law of the Court of Justice concerning social rights – such as the right to an annual period of paid leave – which shows to progressively strengthen the enforceability of the provisions of the Charter.
