Traditionally, it is said that articles 491, 492 and 493 of Civil Code foresee hypothesis of presumptions of fault. In question, however, is the shift of the burden of proof and also the fact that particular hypotheses of tort law, concerning the situation focused on the these articles is reconfigured. Thus, taking into account tort law; we will try to determine at what level the traditionally designated presumptions of fault in the precepts operate. On the other hand, we will take into account the need to establish a distinction - not insignificant in practical and normative terms - between the hypotheses of articles 491, 492 and 493/1 and of article 493/2 CC. To this conclusion we arrive not only through tire analysis of tire scope of the precepts, but also by its problematic reference to tire system - understood as problem - and to the grounds on which it is based.
