This paper investigates the question of the evolution of international human rights law in its substantive and procedural dimensions. The adoption of the Maastricht Principles on Extraterritorial Obligations of States in the Area of Economic, Social and Cultural Rights by a group of international legal experts in September 2011, clarifying the existence and nature of obligations of States to persons beyond their borders, signals the completion of the international human rights law project. This paper seeks to unpack this moment of change. The paper locates the genesis of the Maastricht Principles decades earlier, with roots in historical transformations of international life and in judicial responses to these shifts in State behaviour. Taking the development of the Maastricht Principles as a case study, this paper seeks insight on the anatomy of normative and legal change, highlighting the complementary role of legal doctrine in the progressive development of international law and patterns of global governance.
