The study explores the essence of the trademark of the European Union, as this is a topical subject of major importance both for the EU Law and the growth strategy Europe 2020. Under the light of the normative evolution of the topic and recent judgments of the European Court of Justice on the point, the analysis touches upon some key novelties concerning the EU trademark, also with a view to assessing the threshold of legal certainty reached by the new discipline and the subjective juridical situation of either the registered EU trademark 's owner or who seeks to obtain the registration of an EU trademark. In particular, the attention is first directed to pivotal aspects leading to the establishment of an EU trademark, notably the signs allowed to constitute it and the grounds for refusal of registration; then, the article addresses the heart of the EU trademark, which means its effects, the limits to the rights conferred to its owner and its genuine use.
