By its order No. 24/2017 the Italian Constitutional Court requested the Court of Justice of the European Union to give a ruling on whether national courts may disregard the judgement given by the Court of Justice in Taricco (case C-105/14) in so far as the effects of that decision conflict with a fundamental principle of the Italian Constitution, namely the principle of legality in criminal matters, as applied to the statute of limitations. The Constitutional Court asked whether in Taricco the Court of Justice considered that Article 325 TFEU is applicable only to the extent that it is compatible with the national identity or the constitutional tradition of the Member State concerned, leaving it to the competent national authority to make the necessary assessment. The Constitutional Court’s requests is in substance directed to a revision of the Taricco judgment. In the author’s view, the order challenges the principle of primacy of EU law and leads to a conflict between Italian law and EU law.
