The essay aims at analyzing the so called “administrative recourses” (that is to say the recourses before the administration itself) as alternative dispute resolution methods. The author thinks that the reason way this kind of remedies is in crises is both the lack of promptness, efficiency and independence of the public body which enacts the decision and the difficulty, for Italian way of thinking, to give value to a non judicial decision. The author, then, analyses the history of the extraordinary recourse to the President of the Republic, which has been defined by the Cassation Court as a jurisdictional remedy and by the Constitutional Court as an ADR, inside the administration.
