The subject of this article is cross-border electronic evidence gathering. First, the process of recognition and execution of the European Production Order will be examined, followed by the process of non-execution of the European Production Order and the consequences of the above-mentioned non-execution. The entire work will be analyzed in the context of the executing authority which is the legal representative of the service provider. Analysis of the deficiencies of the above-mentioned processes in light of the threats to the rights of the suspect / accused will play a key role.
