Article 33.°/2 of the Decree-Law n.° 7/2004 determines, concerning contracts concluded exclusively between computers, without human intervention, that the provisions of the Civil Code on mistake apply and distinguish between mistake in the formation of the will, when there is a programming error, mistake in the declaration, when there is a malfunction of the machine, and a mistake in the transmission, when the message arrives deformed to its destination. Legal discipline is not free of difficulties, in determining the transposition of the common mistake regime into a new negotiating reality endowed with its idiosyncrasies. In the following pages, after we make some brief considerations about the mistake in the formation of transactions, ore will try to reflect about how to reconcile the general regime of mistake with the regime of mistake in e-commerce.
