The European Union exclusive competence on foreign direct investments should imply the inclusion of the arbitration clause in agreements that the EU will sign with third parties, alone or with Member States. Given that the EU has accepted investor-State arbitration as a mechanism to solve disputes, it has to provide for a regime of responsibility, applicable in case of disputes concerning mixed agreements. Accordingly, the EU has recently enacted the Regulation no. 912/2014, which defines the criteria for the allocation of responsibility and the identification of the respondent party. This paper aims to scrutinize the Regulation in order to understand the regime of responsibility adopted, through the lens of international provisions and with regard to the most recent European practice in the field. The conclusion is that the regime adopted does not represent the best choice for managing arbitral disputes involving mixed agreements.
